Privacy policy

This Privacy Policy outlines how Happitech B.V. (“Happitech”, “we” or ”our”) may gather and use personally-identifying information (“Personal Data”), and non-personally-identifying information (“Anonymous Data”) when you download and interact with the Happitech iOS application “Skip a Beat: Heart Rate Game” (the “App”). Please read this policy carefully before downloading and using the App.

 

What We Collect

Personal Data

Happitech B.V. is strongly committed to protecting the privacy of its user community. We do NOT collect or store any personally-identifying information about you such as your name, address, telephone number, or e-mail address through our App. Potentially-identifying information such as your birth date remains on your iPhone/iPad and we will have no access to it.

The App requires the use of the camera on your device for video input in order to measure your heart rate. Images from the camera feed are processed locally on your iPhone or iPad and cleared immediately afterwards. We do not collect any images obtained from the camera feed.

When you send comments, questions, suggestions, or feedback to Happitech B.V. via email, and include an email address and/or contact information we may use this information to respond to you. Note that your email address and/or contact info is not linked to any of the de-indentified data we may collect as described below.

 

Anonymous Data

All data Happitech B.V. collects is de-identified, which means the data that by itself does not permit the identification of individual persons. Anonymous data we collect may include your age and country. We may also collect waveforms related to your heart signal obtained from the processing of the camera input.

We may collect statistics about the behavior of users of the App to understand how they interact with the App and for error reporting. For instance, we may monitor which part of the App and its related features you are interested in and your usage patterns. These statistics are collected by Game Analytics. We collect such information only in so far as is necessary or appropriate to fulfill the purpose of your interaction with the App. You can always refuse to supply user data, with the caveat that it may prevent you from engaging in certain App-related content. By voluntarily providing us with your Anonymous Data, you are consenting to our use of it in accordance with this Privacy Policy.

 

How We Use Your Data

The Anonymous Data you provide allows us to perform accurate analysis and generate the appropriate statistics relevant to you. For example, to evaluate whether players are able to master their heart rate in the different game modes from calm to excited. Collecting the waveforms related to the heart signal allows us to continue to test new features, and refine our heart rate algorithms. We will use the Anonymous Data to better understand our users as well as to improve the content and functionality of the App.

If you contact us by e-mail, we may use the mail you provided to answer your question or resolve your problem. If you are a registered user or have voluntarily supplied your email address such as when you contact us with inquiries, Happitech B.V. may occasionally send you an email to tell you about new features, solicit your feedback, or just keep you up to date with what’s going on with Happitech B.V. and our products. You can always opt out by clicking on the “Unsubscribe” link appended to the end of the emails.

We may conduct research on our end user’s demographics, interests and behavior based on the Anonymous Data. This research may be compiled and analyzed on an aggregate basis, and we may share this aggregated data with our affiliates, agents and business partners. This aggregate information does not identify you personally. We may also disclose aggregated user statistics in order to describe our services to current and prospective business partners, and to other third parties for other lawful purposes.

 

Security Policy/Procedures

As described above, we only collect Anonymous Data, except in the case where you send comments, questions, suggestions, or feedback to Happitech B.V. via email. Access to all user data is limited to authorized employees or contractors that (i) need to know that information in order to process it on our behalf or to provide services available in the App, and (ii) that have agreed not to disclose it to others.

We will not rent or sell Personal Data to anyone. We may disclose Personal Data only in response to a subpoena, court order or other governmental request, or when we believe in good faith that disclosure is reasonably necessary to protect the property or rights of Happitech B.V., third parties or the public at large.

We take all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of user data. However no system can be 100% secure, and therefore despite our best efforts, there could be unauthorized access to this data and therefore by using the App you accept this risk.

 

Data Retention

We will retain de-identified and anonymous data for an indefinite amount of time for research and development purposes. If you contacted us via email, your email will be retained for communication purposes as long as you use the App and for a reasonable time thereafter. If you believe we have personal information about you that you do not want us to have or would like to request of a copy of your personal information collected, please contact us as described below (see “Contact Us”) and we shall remove the data as you request or send you a copy as soon as is reasonably practicable.

 

Children

We do not knowingly collect Personal Data from children under the age of 13 and do not target our websites to children under 13. If you are under 13, you should not provide any personal data to us. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy by instructing their children to never provide Personal Data through the App without their permission. If you have reason to believe that a child under the age of 13 has provided Personal Data to us, please contact us (info@Happitech.com), and we will endeavor to delete that information from our databases.

 

Cookies

A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. We may use cookies to help us identify and track visitors, their usage of Happitech B.V. website and Skip a Beat website (Happitech.com, skipabeatgame.com, skipabeatapp.com, heartrateapp.com), and their website access preferences. Visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using Happitech’s websites, with the drawback that certain features of Happitech’s websites may not function properly without the aid of cookies.

 

Business Transfers

If Happitech B.V., or substantially all of its assets, were acquired, or in the unlikely event that Happitech B.V. goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of Happitech B.V. may continue to use your personal information as set forth in this policy.

 

Privacy Policy Changes

Although most changes are likely to be minor, Happitech B.V. may change its Privacy Policy from time to time, and in our sole discretion. We may choose to notify you via a Push notification or in the “What’s New” section of an App Update. We encourage visitors to frequently check this page for any changes to its Privacy Policy. Your continued use of the App after any change in this Privacy Policy will constitute your acceptance of such change.

 

Data Ownership Policy

Definitions of Data

As used in this policy, “data” means information that is collected and/or generated in or as a result of interaction with the Happitech iOS application Skip a Beat: Heart Rate Game (the “App”) and recorded in any tangible or electronic medium, including without limitation laboratory notebooks and worksheets, memoranda, notes, clinical protocols, computer databases, computer images, and all other records. This includes original and derivatives of research data, including recordings of such data.

 

Ownership of Data

All data generated by users of the App or created with the App shall be owned by Happitech B.V. (“Happitech”). Happitech may, at its discretion, transfer the ownership of data to the creator(s) of said data with a property transfer agreement between the Happitech B.V. and the creator(s).
